Terms of Service

Last updated: April 12, 2025

Please read these Terms of Service (“Terms”) carefully before placing an order with Brickhouse Embroidery. By using our website or purchasing from us, you agree to these Terms. If you do not agree, please do not use our site.

1. About Us

Brickhouse Embroidery is a firefighter-owned embroidery and custom gear business operating at 7932 Troup Ave, Kansas City, KS 66112. We produce custom embroidered patches, hats, shirts, jackets, and related gear primarily for first responders and public safety professionals.

2. Custom Orders & Production

Most items we sell are custom-made to order. By placing an order you acknowledge:

  • Production time — Standard orders take 7–10 business days in production before shipping. Rush orders are processed within 2 business days. These are estimates and may vary during high-demand periods.
  • Customization accuracy — You are responsible for ensuring all customization details (names, badge numbers, text, colors) are correct at the time of ordering. We produce exactly what is specified.
  • Color variation — Embroidery thread colors may vary slightly from what is displayed on screen due to monitor calibration differences. Thread colors are matched to our standard palette.
  • Design approval — For complex or custom designs, we may contact you prior to production for approval. Failure to respond within 3 business days may delay your order.

3. Pricing & Payment

All prices are listed in US dollars. We reserve the right to correct pricing errors. If an item is priced incorrectly due to a technical error, we will contact you before processing your order.

Payment is processed securely through Stripe. We accept major credit and debit cards. Your card is charged at the time of order placement. Bulk orders with a purchase order may be invoiced separately — contact us to arrange.

Free shipping applies to orders over $100 (before tax). Orders below $100 are charged actual shipping rates via our carrier at checkout.

4. Returns, Refunds & Defects

Because our products are custom-made to order, we do not accept returns or offer refunds for reasons such as change of mind or incorrect information entered at checkout.

We will, however, remedy the following at no charge:

  • Manufacturing defects (poor stitching, embroidery errors on our part)
  • Items that differ materially from what was ordered due to our error
  • Damaged items upon arrival

To request a remedy, contact us within 14 days of delivery at brickhouseembroidery@gmail.com with your order number and photos of the issue. We will remake or refund at our discretion. See our full Returns & Refund Policy for details.

5. Shipping

We ship via standard carriers (USPS, UPS, FedEx) based on the rates calculated at checkout. We are not responsible for delays caused by carriers, weather events, or address errors provided by the customer. If a package is returned due to an incorrect address, you will be responsible for reshipping costs.

Risk of loss passes to you upon our delivery of the package to the carrier. For lost or stolen packages, we will assist in filing a carrier claim but cannot guarantee reimbursement.

6. Intellectual Property

When you submit logos, images, or artwork for embroidery, you represent and warrant that you have the legal right to use and reproduce that artwork. We will not produce items that infringe on third-party intellectual property rights. You indemnify Brickhouse Embroidery against any claims arising from artwork you submit.

All original designs, photographs, and content on our website are owned by Brickhouse Embroidery and may not be reproduced without written permission.

7. Bulk & Department Orders

Bulk orders placed through our website or submitted via purchase order are subject to minimum quantity requirements as described on our Bulk Orders page. Volume discounts are applied automatically based on quantity. Cancellations of bulk orders that are already in production may not be eligible for a full refund.

8. Accounts

You may create an account to track orders and save information. You are responsible for keeping your account credentials confidential. We reserve the right to suspend or terminate accounts for abuse or violation of these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, Brickhouse Embroidery’s liability for any claim arising from your use of our site or purchase of our products is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyandotte County, Kansas.

11. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a new “Last updated” date. Continued use of our site after changes constitutes acceptance.
